INSLM Hearing

On 10 March 2026, representatives from the Law Council appeared as witnesses at a public hearing held by the Independent National Security Legislation Monitor (INSLM) in relation to his inquiry into the definition of a “terrorist act” in section 100.1 of the Criminal Code Act 1995 (Cth). 

At this hearing, the INSLM called on the Law Council to expand upon arguments made in a written submission it provided to the review on 27 November 2025. The Law Council, represented by expert members of its National Security Working Group and National Criminal Law Committee, welcomed the opportunity to provide feedback on the INSLM’s proposals to refine the definition to better address emerging risks to national security from political violence.

Our evidence focused on improving the clarity of proposed reforms to the definition. The INSLM sought the Law Council’s views on how a draft definition of “ideology” might assist to modernise the definition of a “terrorist act” to better address contemporary risks while improving compliance with key rule of law principles. The INSLM was also interested in the Law Council’s views regarding the proper scope and construction of the types of activity that might constitute a terrorist act.

The Law Council welcomed the opportunity to give evidence at the hearing, and continues to support the INSLM’s important work in providing independent and expert consideration of Australia’s national security legislation.
