Nature Positive Laws

On 26 July 2024, the Law Council appeared before the Environment and Communications Legislation Committee in its inquiry into the Government’s Stage 2 Nature Positive Bills.
While the Law Council welcomed the introduction of the Bills into Parliament, we noted that each of the Bills had scope for significant improvement. The Law Council made a number of recommendations to improve the Bills, including an independent skills-based board for the new Environment Protection Australia and the inclusion of a baseline and target year in the definition of nature positive. Further, the Law Council indicated that the process that has been employed and developed to scrutinise the proposed legislation failed to reflect the breadth and significance of the reforms outlined in the Bills.
