Reform of Australia’s Electronic Surveillance Framework: Discussion Paper

The Law Council is contributing to a major reform of Australia’s electronic surveillance laws. The Australian Government has accepted recommendations of a major review of the legal framework for the national intelligence community to consolidate and modernise existing Commonwealth legislation regulating the use of surveillance devices, telecommunications interception and remote computer access.
This body of work is being managed by the Department of Home Affairs, and the drafting of a new Act is expected to take around 24 months. The Law Council recently made a submission to the Department on an initial discussion paper seeking stakeholder views on guiding principles for the design of a new Act.
The Law Council looks forward to working constructively with government in future consultations, including on draft legislation. Constituent Bodies will be contacted in advance of future consultation rounds.
