Review of the Federal Circuit and Family Court of Australia Act 2021

The statutory review of the Federal Circuit and Family Court of Australia Act 2021 (FCFCOA Act) commenced on 2 September 2024. The Attorney-General appointed the Hon Linda Dessau AC CVO and Professor Helen Rhoades OAM to conduct the review. The terms of reference for the review are available here. The reviewers are required to provide a report to the Attorney-General on or before 1 March 2025.

In September and October 2024, the Law Council arranged for experts from various parts of the profession to attend virtual roundtables directly with the reviewers, at their request. The reviewers met with a variety of groups as part of this roundtable process, and the reviewers indicated that a public consultation process would follow.

This public online consultation launched on 25 November and is open until Thursday, 12 December 2024. The consultation is available at: consultations.ag.gov.au/legal-system/fcfcoa-act-review.

The reviewers’ focus is now on providing professionals who interact with the FCFCOA (Division 1) and/or the FCFCOA (Division 2), especially legal practitioners, with the opportunity to share their individual experiences of the impact of the structural reforms.

Given this focus, noting the variety of practice areas within the FCFCOA’s two Divisions and the relatively short consultation timeframe, the Law Council is not proposing to prepare a submission in this instance. Rather, we encourage interested members of the profession to respond directly to the online consultation by the deadline.
