Social Services Legislation Amendment (Encouraging Self-sufficiency for Newly Arrived Migrants) Bill 2018

On 16 April 2018, the Law Council provided a submission to the Senate Community Affairs Legislation Committee in relation to proposed measures that seek to increase the waiting period for certain welfare payments for newly arrived migrants.

In its submission, the Law Council raised several concerns with the Bill, most notably the limited information justifying how the Bill is addressing a pressing or substantial concern.

This justification was considered particularly critical in light of the potential for the measures to further limit recognised human rights for a cohort of the population, including the right to social security and parental leave.

The Law Council further pointed out the potential for the measures to create significant hardship on newly arrived migrants, a section of the community that is already susceptible to vulnerability and marginalisation.
