Policy Statement - Mandatory Sentencing

This paper sets out the views of the Law Council of Australia in relation to the appropriateness of mandatory sentencing laws. The Law Council is opposed to mandatory sentencing because, except in very limited circumstances, it excludes the exercise of judicial discretion.

This paper also sets out the Law Council's views in relation to available options and relevant obligations for the Commonwealth government arising under international law.
