Policy Statement - Principles Applying to Detention in a Criminal Law Context

A key objective of the Law Council of Australia is the maintenance and promotion of the rule of law. For this reason, the Law Council often provides analysis of federal legislation and federal executive action based on the Law Council’s Policy Statement on Rule of Law Principles.
This document seeks to expand on those principles as they apply to the arrest, detention and imprisonment of individuals in a criminal law context. They are not intended to apply to other forms of detention such as that imposed for mental health or quarantine purposes.
