2013 Review of the Franchising Code of Conduct
Submission Date: 22 February 2013
The Competition and Consumer Committee of the Business Law Section of the Law Council of Australia (the Committee) provided a submission concerning the issues covered by the terms of reference for the Review of the Franchising Code of Conduct (Code) for consideration.
The Committee's submission focuses on three key themes relevant to the Review:
- good faith in franchising;
- enforcement of the Code, in particular the proposal to introduce civil penalties for breaches of the Code; and
- the need for consistent and uniform national regulation.
