ACNC Deidentified Decisions

This submission has been prepared by the Charities and Not-for-profits Committee of the Law Council of Australia’s Legal Practice Section (Committee). The Committee wishes to provide feedback to the Australian Charities and Not-for-profits Commission (ACNC) regarding its published ‘de-identified registration decision summaries’ (Decision Statements).
The ACNC has published five Decision Statements to date, as part of its Secrecy Reform Project. The ACNC, the Charity & Not-for-Profit Law Committee of the Legal Practice Section of the Law Council of Australia (the Committee) has some feedback in relation to these Decision Statements.
The Committee welcomes the step the ACNC has taken in releasing information on the reasons upon which it has made registration decisions, to support the understanding of practitioners and also the public of the ACNC’s approach to trickier or more borderline applications particularly in the absence of the ACNC being able to provide private rulings.
The Committee hopes this feedback will assist the ACNC to ensure that future Decision Statements it publishes better meet the ACNC’s objective of providing an educational benefit for the charity sector and contribute towards greater transparency about the ACNC’s work.
