Administrative Review Tribunal Practice Directions

The Law Council of Australia provided feedback on the following Administrative Review Tribunal Practice Directions:

The Law Council commends the Tribunal for conducting this review. We expect that this process will assist in ensuring that the Practice Directions remain fit for purpose, are responsive to emerging issues, and are meeting the needs of parties, including those who are self-represented. We encourage the Tribunal to continue conducting periodic reviews of the Practice Directions.

In July and September 2024, the Law Council provided feedback on draft versions of each of the Practice Directions listed above, with the exception of the Expert Evidence Practice Direction, which we did not have an opportunity to provide feedback on at the time.

It is pleasing to note that some of the Law Council's comments and recommendations were addressed by the Tribunal prior to the publication of the Practice Directions. Nonetheless, many of the Law Council's queries and suggestions remain unaddressed. The Law Council reiterates these comments, to the extent that they remain relevant.

For ease of reference, the table in the submission sets out the feedback that the Law Council previously provided to the Tribunal in 2024 in respect of each draft Practice Direction (apart from the Expert Evidence Practice Direction). A new column has been added to the table that provides brief commentary on the changes made, including observations as to whether our comments were incorporated into the published Practice Directions.
