Computer Implemented Inventions, Mere Schemes and Business Methods’ post Aristocrat

The Intellectual Property Committee (IPC) of the Business Law Section of the Law Council of Australia welcomes the opportunity to make this submission to IP Australia in relation to the drafting of section 5.6.8.6 of the Patent Manual of Practice and Procedure titled ‘Computer Implemented Inventions, Mere Schemes and Business Methods’.

The comments that are provided in the submission are provided on the IPC’s understanding that the aim of this section of the Manual is to reflect and summarise, as accurately as possible, the current state of the law relating to computer-implemented inventions (CIIs). In doing so, the IPC acknowledges that:

  1. there are no ‘bright-line tests’ for patentability of CIIs; and
  2. individual cases may raise complex issues for evaluation by an Examiner.
