Consultation on Proposed Reforms to the Execution of Commonwealth Statutory Declarations
The Law Council of Australia provided a submission to the Attorney-General’s Department (the Department) in relation to consultation on proposed reforms to the execution of Commonwealth statutory declarations.
The Law Council supports the continued modernisation of arrangements for the execution of legal instruments. As was emphasised in its 2021 submission to the Deregulation Taskforce at the Department of the Prime Minister and Cabinet, the Law Council encourages an approach that emphasises facilitation of document execution without unnecessary technical requirements, while recognising that existing benefits of current legal requirements for execution and witnessing should be retained and, where possible, enhanced.1
