Consumer Guarantees and Supplier Indemnification Under the Australian Consumer Law (ACL)
The Competition and Consumer Law Committee of the Business Law Section of the Law Council of Australia (the Committee) welcomes the opportunity to comment on Treasury’s consultation paper ‘Consumer guarantees and supplier indemnification under the Australian Consumer Law: Consultation on the design of proposed new civil prohibitions and penalties’.
The Committee considers that prohibitions and penalties should not be introduced until and unless there is greater certainty and clarity around what constitutes a major (and minor) failure of a good or service, as well as the available remedies.
