Background

This submission is made by the Financial Services Committee of the Business Law Section of the Law Council of Australia in response to the consultation statement for CS 47, released by the Australian Securities and Investments Commission (ASIC) on 23 March 2026.

The consultation concerns the proposed remake of ASIC Corporations (Managed Discretionary Account Services) Instrument 2016/968, which is due to expire on 1 October 2026.
