Enhancing member protections in the superannuation system

The Legal Practice Section of the Law Council of Australia welcomes the opportunity to respond to the Treasury’s Consultation Paper titled Enhancing member protections in the superannuation system. This submission is informed by contributions from the Legal Practice Section’s Superannuation Committee and Consumer Law Committee.
The Consultation Paper seeks feedback on proposals for enhancing member protections in the superannuation system. These proposals are being considered in the context of the Shield Master Fund and First Guardian Master Fund matters.
This submission addresses each consultation question in sequence. Where the Legal Practice Section does not consider a question to be applicable, or considers that it raises primarily a policy matter beyond the scope of this submission, that position is identified expressly.
The majority of this submission reflects the views of the Legal Practice Section’s Superannuation Committee. However, additional comments from the Consumer Law Committee are included and attributed accordingly. This is particularly the case in the response to Question 38 in the submission.
