Financial Services Legislation: Interim Report B (ALRC Report 139)
The Law Council of Australia and its Business Law Section is pleased to make this submission in relation to Interim Report B of the Australian Law Reform Commission’s (ALRC) Review of the Legislative Framework for Corporations and Financial Services Regulation (Inquiry).
This submission offers general observations as to the scope and nature of the Inquiry, before specifically responding to each of Interim Report B’s Proposals and Questions. Interim Report B sets out options for reform relating to a legislative hierarchy model and improvements to the design of the legislative framework for corporations and financial services, and poses two questions in relation to draft guidance on the delegation of legislative power and the use of evidential provisions respectively.
The Law Council has provided responses to each of these proposals and questions in the below table at Appendix A.
