Fourth Cycle Universal Periodic Review of Australia
Submission Date: 16 July 2025
This submission focuses on what the Law Council considers are the most pertinent current human rights and rule of law issues in Australia. This includes:
- the need for Australia to adopt a federal human rights act;
- the crisis state of Australia’s child justice system; and
- the over-incarceration of First Nations people.
It also addresses the implementation of the recommendations of Australia’s Third Cycle Universal Periodic Review across other human rights issues concerning justice, equality and safeguards for individual rights, acknowledging that Australia has taken positive steps in this respect since that time.1
1 Examples of progress by Australia in this submission include the commencement of the National Access to Justice Partnership (see paragraph 20); Australia’s acceptance of a recommendation for national cultural heritage legislation (see paragraph 24); Australia’s acceptance and further consideration of most recommendations of the Disability Royal Commission for which it has primary or shared responsibility (at paragraph 25); Australia’s release of its Nature Positive Plan (at paragraph 37) and the establishment of an independent Australian Anti-Slavery Commissioner (at paragraph 38).
