Introducing Mandatory Guardrails for AI in High-risk Settings: Proposals Paper
The Law Council of Australia provided a submission to the Department of Industry, Science and Resources in response to its Proposals Paper on the introduction of mandatory guardrails for artificial intelligence (AI) in high-risk settings.
In our view, the Proposals Paper has been thoughtfully prepared. It is based on the premise that AI (in its various forms) has the potential to improve social and economic well-being, whilst also bringing both foreseeable and unforeseeable risks of harm that may not be adequately remediable under Australia’s current regulatory framework.
The tenor of the Proposals Paper is to minimise the risk of potential harms without unduly limiting innovation or driving it offshore. The Law Council considers it critical that any regulatory framework adopted in Australia should be flexible and scalable to future technological change, and so will allow for sufficient innovation, while maintaining appropriate guardrails. To this end, we agree with the Proposals Paper’s focus on a risk-based approach with an emphasis on preventative measures.
