Reforms to the Native Title System – Exposure Drafts
The submission to the Attorney-General's Department in relation to the proposed reforms to the Native Title System as set out in the following Exposure Draft documents released by the Department:
(a) Native Title Legislation Amendment Bill 2018 (Exposure Draft Legislation); and,
(b) Registered Native Title Bodies Corporate Legislation Amendment Regulations 2018 (Exposure Draft Regulations) was prepared by the Law Council.
The Law Council welcomes the ongoing reform of the native title regime and notes that the extensive litigation and procedural activity associated with the regime gives rise to many operation issues and norms.
In this submission the Law Council indicates its support for the many aspects of the proposals. There are some aspects which, in the Law Council’s view, require further work or explanatory material. Other proposals are opposed for the reasons set out in the submission.
