Review into Australia’s corporate criminal responsibility regime

The submission to the Australian Law Reform Commission (ALRC) on the scope of the inquiry and issues relevant to its Terms of Reference for the review into Australia’s corporate criminal responsibility regime (the Review) was prepared by the Law Council. 

The Law Council is grateful for the assistance of its National Criminal Law Committee and Corporations Law Committee of its Business Law Section. 

The Law Council acknowledges that corporations and the people who carry out the activities of corporations should be held to the general standards of criminal responsibility that apply to all members of the community, with the same application of the principles that underpin the rule of law.
