Review Into the Effectiveness of the Prohibited Energy Market Misconduct Act 2019 (PEMM Act)

The Competition and Consumer Committee of the Business Law Section of the Law Council of Australia (the Committee) appreciates the opportunity to comment on the Treasury Laws Amendment (Prohibiting Energy Market Misconduct) Act 2019 (Cth) as part of its review.
The Committee holds concern about the Act in its current form and details these issues in the submission. The Committee urges that close consideration be given to the ongoing relevance and appropriateness of the Act in its current form.
