Review into the operation and effectiveness of the National Security Information (Criminal and Civil Proceedings) Act 2004
The Law Council provided a submission to the Independent National Security Legislation Monitor’s (INLSM’s) review into the National Security Information (Criminal and Civil Proceedings) Act 2004 (Cth) (NSI Act).
The Law Council recognises the need for mechanisms to be available to the courts to protect the confidentiality of national security information in the course of federal proceedings. It also recognises that such mechanisms may have an impact on the conduct of certain proceedings, including on the ability for parties to access and disclose certain information and the ability for the public to know about the due administration of justice in the courts.
