Supplementary Submission: Inquiry into the impact of the exercise of law enforcement and intelligence powers on the freedom of the press

The supplementary submission to the Parliamentary Joint Committee on Intelligence and Security in response to the joint supplementary submission (joint submission) provided by the Department of Home Affairs and the Australian Federal Police as part of the committee’s inquiry into the impact of the exercise of law enforcement and intelligence powers on the freedom of the press was prepared by the Law Council. 

The Law Council notes that the joint submission proposes to establish a Notice to Produce framework in the Crimes Act 1914 (Cth) as an additional method for law enforcement agencies to obtain evidence during investigative action in relation to a professional journalist or media organisation. This proposed scheme would be targeted at investigations relating to a professional journalist or media organisation involved in the unauthorised disclosure of material or the obtaining of such material from a current or former Commonwealth officer.
