Supplementary submission: Review of the amendments made by the Telecommunications and Other Legislation Amendment (Assistance and Access) Act 2018 (Cth)

The supplementary submission to the inquiry of the Parliamentary Joint Committee on Intelligence and Security (Committee) into the Telecommunications and Other Legislation Amendment (Assistance and Access) Act 2018 (Cth) (TOLA Act) was prepared by the Law Council of Australia. 

This submission supplements the Law Council’s evidence to the Committee at its public hearing on 27 July 2020. Committee members expressed interest in receiving a further written submission from the Law Council detailing its views on the recommendations of the third Independent National Security Legislation Monitor (INSLM), Dr James Renwick CSC SC, in his report of 30 June 2020, entitled Trust But Verify: A Report Concerning the Telecommunications And other Legislation Amendment (Assistance and Access) Act 2018 and Related Matters (INSLM report).1

The Law Council has provided its comments on each of the INSLM’s 33 recommendations in Appendix 1. This appendix also highlights several outstanding issues that were not the subject of examination in the INSLM report, in respect of which the Law Council continues to recommend amendments.2
