Treaty on Extradition Between Australia and the People’s Republic of China
The submission to the Joint Standing Committee on Treaties’ (the Committee) in response to its inquiry into the Treaty on Extradition Between Australia and The People’s Republic of China (the Treaty) was prepared by the Law Council of Australia.
The proposed Treaty would extend the circumstances in which Australia and China will be able to consider requests for extradition from each other. Prior to the Treaty coming into force, it is proposed that regulations will be made under the Extradition Act 1988 (Cth) (EA) to declare China as an ‘extradition country’, and will specify that the EA applies in relation to China subject to the Treaty.1
