Administrative Review Tribunal Practice Directions: Six-month Review
11 July 2025
On 26 June 2025, the Law Council provided a submission to the Administrative Review Tribunal’s (ART) review of its Practice Directions.
Since commencing operations on 14 October 2024, the ART has published six Practice Directions covering a range of operational and procedural matters for those interacting with the ART. Six months later, the ART has sought views on how its Practice Directions have been operating, and on whether any changes ought to be considered to enhance their effectiveness.
The Law Council’s submission supported the ART’s decision to review its Practice Directions, noting the importance of ensuring these documents remain fit for purpose, are responsive to emerging issues, and are meeting the needs of parties, including those who are self-represented. The Law Council’s feedback to the ART drew on perspectives put forward by multiple Constituent Bodies, Sections and Advisory Committees, and ranged from general feedback on accessibility, through to specific comments on how individual provisions can be improved.
The Law Council looks forward to continuing to work with the ART to ensure existing and new Practice Directions remain appropriate. To this end, we have encouraged the ART to continue conducting periodic reviews of its Practice Directions, and through this process we will continue to represent the view of the legal profession in responding to future consultations.
