The protection of human rights of people born with variations in sex characteristics in the context of medical interventions

On 12 October 2018, the Law Council provided the Australian Human Rights Commission with a submission in relation to its consultation on the protection of human rights for people born with variations in sex characteristics in the context of medical interventions.
In its submission, the Law Council noted the strong human rights concerns associated with medical interventions for people born with variations in sex characteristics without the capacity to consent, and endorsed the need for appropriate oversight of such decisions.
The Law Council has also called for nationally consistent clinical guidelines to be developed to guide medical decisions in this context, which should adopt a human rights-based approach and a holistic analysis of the rights of the child. The Law Council looks forward to further dialogue with the Human Rights Commission on this issue as its consultation progresses.
