Consultation on Competition and Consumer Amendment (National Access Regime) Bill 2021
The submission to the Treasury in response to the consultation on the Competition and Consumer Amendment (National Access Regime) Bill 2021 (Bill) was prepared by the Competition and Consumer Committee of the Business Law Section of the Law Council of Australia (Committee).
The Bill removes the ability of the Australian Competition Tribunal (Tribunal) to review a decision of the designated Minister to declare a service, not declare a service or not revoke a declaration. The Committee refers to its submission dated 19 April 2021. It does not support the proposed repeal of merits review by the Tribunal, for the reasons set out in that submission.
