Industrial Law Committee
The primary purpose of the Industrial Law Committee is to be an expert panel available to draft or contribute to Law Council submissions on law reform in respect of employment and industrial law, in particular responding to:
- Australian Government consultations on matters of federal industrial law; and
- parliamentary committees inquiring into the merits of particular federal bills
The committee focuses on:
- policy questions about which the committee has a unanimous view, for example the need for amendments to the Fair Work Act 2009 (Cth) so that there is a right to representation before the Fair Work Commission;
- the institutional integrity of the system, including how members are appointed to the Fair Work Commission, the jurisdiction they are given, and how legislation may alter the operation of jurisdiction; and
- when reviewing draft bills, whether the bill as drafted is in fact meeting its apparent purpose or whether there are unintended consequences.
The Committee’s secondary aim is to arrange expert level seminars in conjunction with member bodies of the Law Council, namely the law societies and bar associations.
